CommandLink Auto Pay Terms and Conditions
Parties and Authority. In this CommandLink Auto Pay Terms and Conditions ("Terms and Conditions"), "CommandLink," "We," and "Us" mean CommandLink, LLC and its affiliated companies, successors, and assigns, and "You" and "Your" mean the person providing or designating the Payment Method (as defined below) information and authorizing the AutoPay (as defined below), that person's company and/or employer, which company is a customer of CommandLink (the "Company"), and/or any other person who is authorized to make purchases or obtain Services from CommandLink to be charged to the Payment Method. By accepting these Terms and Conditions, You (1) agree that You are accepting these Terms and Conditions on behalf Your Company; (2) represent and warrant that You are an authorized representative of the Company with the authority to bind the Company; and (3) agree to these Terms and Conditions on behalf of the Company. These Terms and Conditions constitute a legal and binding agreement between You and CommandLink and are in addition to, and not in lieu of, any other agreements between You and CommandLink. Capitalized terms used but not defined herein have the meaning assigned in the Master Service Agreement ("MSA") between the Company and CommandLink.
Auto Pay Authorization. By checking the box "Sign up for monthly auto pay?" and selecting the "Submit Payment" button or otherwise indicating your consent to authorizing automatic monthly payments, You authorize Us to automatically charge to the Payment Method the current balance on Your account, including amounts set forth in any monthly invoices or other payment notices that may be sent to You ("AutoPay"). Payments subject to AutoPay include any final amount due if a CommandLink Service is cancelled or terminated, which amounts can include, without limitation, any applicable Termination Fees or other cancellation fees and equipment non-return fees. Closing, cancelling, or terminating a Service or Account does not cancel or terminate this AutoPay for remaining amounts due. If a charge to the Payment Method is declined, including for insufficient funds, We may re-submit the charge, and We reserve the right to undertake further action as permitted under the MSA or as permitted by law.
Payment Method. "Payment Method" means the bank account, credit card, debit card or other payment method information You provide to Us during Your transaction authorizing AutoPay.
Payment Method Information. You agree to keep any payment method information You provide today up to date. You can update or change any Payment Method information You provide by signing into your account at www.commandlink.com, which updated or changed information will become the Payment Method for this Authorization. If you do not update Your Payment Method and We are unable to timely charge Your Payment Method for the amount due on Your account, You may be subject to applicable late fees and any fees or charges assessed by Your financial institution. You acknowledge that We may obtain updated information regarding any payment method You provide today from Your financial institution and that any such updated payment information will become the Payment Method for this Authorization.
Revocation. The AutoPay service and authorization will remain in effect until revoked by You, Your financial institution, or CommandLink. You may revoke this AutoPay by emailing [email protected] and requesting revocation of the AutoPay, which revocation will take effect within 5 business days of receipt of such request. If You revoke this AutoPay, or CommandLink or Your financial institution cannot process Your automatic payment, You remain responsible for paying amounts due each billing period and upon termination of Services, including by making payments by check or other payment method on or before each due date.
General. YOU RELEASE COMMANDLINK FROM ANY AND ALL CLAIMS ARISING FROM YOUR USE OF AUTOPAY. COMMANDLINK BEARS NO LIABILITY OR RESPONSIBILITY FOR ANY LOSSES OF ANY KIND THAT YOU MAY INCUR AS A RESULT OF ANY PAYMENT MADE ON ITEMS INCORRECTLY BILLED, ANY DELAY IN THE ACTUAL DATE ON WHICH YOUR ACCOUNT IS DEBITED OR YOUR CREDIT CARD IS CHARGED, OR YOUR FAILURE TO PROVIDE ACCURATE AND/OR VALID PAYMENT METHOD INFORMATION. You agree to be bound by any rules Your financial institution requires for pre-authorized electronic funds transfers and/or that Your debit or credit card issuer requires for pre-authorized debit or credit card transactions. You are responsible for all fees charged by Your financial institution associated with the AutoPay payments. CommandLink reserves the right to change these Terms and Conditions at any time; notice of any such change may be given on or with Your invoice or by any method, including, but not limited to, email. These Terms and Conditions do not in any way terminate, amend, or modify other terms, agreements or policies that apply to Your CommandLink account or any CommandLink Services.
